Please read our terms and conditions of sale prior to purchase. By purchasing from USB Drives For Music Artist ("Company") you ("Customer") agree to the Terms and Conditions below.

General terms (applies to all orders)

CUSTOMER MUST PROVIDE A PHONE NUMBER - This will be used if we have any questions about your order.

RETURN POLICY

Please inspect all of your products as soon as they arrive. Any Defective product must be returned within 14 days, no exceptions. The customer is responsible for the shipping cost to return any defective products to our company. Our company will pay the shipping costs to send a replacement back to the customer. The customer will be given a choice of either a replacement of the defective item(s) or a refund for part or all. Your complete satisfaction is our goal! (See complete return policy below)

PRICING AND DELIVERY

Company reserves the right to modify prices, colors, materials, specifications, and quantities featured on our website or other platforms at any time, without prior notice or obligation.

The prices listed on our website do not include shipping fees. All orders are shipped from Van, WV, unless stated otherwise. Please note that the company is not liable for any loss or damage to products after they have left our premises.

Company charges state and local sales taxes where applicable.

The acceptance of a customer's purchase order does not override or invalidate the terms and conditions outlined on this page.

PAYMENT TERMS

Company accepts VISA, MasterCard, Discover, American Express, and PayPal.

Processing will not begin unless your order is paid in full.

Credit is available through PayPal Credit upon approval. Please view PayPal's terms of service concerning their PayPal Credit Agreement.

CONTENT POLICY

We will not manufacture, sell, distribute, or promote certain content, including content that we determine is hate speech, offensive, exploitative, profanity or explicit language, abusive, pornographic, defamatory, inflammatory, false, fraudulent, unlawful or glorifies or promotes unlawful acts, or is otherwise objectionable. This company caters to the Christian music industry.

Intellectual Property Rights Protection

Customer agrees to indemnify, defend, protect, and hold harmless Company and its subsidiaries and their respective officers, directors, agents, affiliates, distributors, franchisees, and employees (collectively, "indemnified parties") against any liabilities, losses, claims, damages, punitive damages, causes of action, lawsuits, administrative proceedings (including interest from the date of such damages), and costs and expenses (including without limitation reasonable attorneys' fees and disbursements of every kind, nature, and description) (collectively, "damages") suffered, sustained, incurred, or paid by the indemnified parties in connection with, resulting from, or arising out of, directly or indirectly (i) any claim, demand, proceeding, or lawsuit by a third party based on any assertion that the services provided to the Customer under this agreement breaches the patent, copyright, trademark, trade secret, or other proprietary right of such third party and (ii) any breach of any representation or warranty of the Customer set forth in this agreement or the form, Intellectual Property Ownership Agreement, Purchase Order, or in any other form or document in connection herewith.

Company reserves the right, at its sole discretion, to investigate the ownership of any and all materials provided hereunder.

The Customer agrees to provide Company, upon request, all necessary documentation of ownership or other legal rights, including without limitation all pertinent copyright and licensing information. By reserving these rights, Company does not in any way assume an obligation to investigate or verify ownership of any materials provided by the Customer, and Company may rely on the Customer's representations and warranties herein and provided under Company's Intellectual Property Rights Form even if Company investigates such ownership.

If Company determines, or has reason to believe, that the Customer does not have the authority to produce the products sought hereunder, Company will have no further obligations to the Customer to provide any products or any other services with respect to such materials, and Company will return such materials to the Customer.

This Company uses third-party vendors to provide some of its products.

Company does not take any ownership of Customer's Intellectual Property. Company will use all reasonable efforts to protect and safeguard Customer's Intellectual Property while Customer's content is in Company's facility, on Company's servers.

PRICING AND DELIVERY

The Customer's order will be delayed if the Customer has failed to provide to Company all necessary materials (including without limitation master mp3's, graphics, signed Intellectual Property Rights Form, and Audio Track Listing).

Quoted or acknowledged delivery dates are only estimated dates of delivery. Company specifically disclaims liability for delays in delivery and any resulting consequential damage or losses.

Warranty of product, limitation of liability, and indemnification

USB 4" x 4" COVER CARDS

USB cover cards are the same thing that you would normally get in a CD case. The front has your album front cover and the back card has your music listings. Both front and back are on a 4" by 4" card for the customer to insert into their USB Zipper bags and comes in full color on both sides.

Customer must approve the proofs of the front and back cover cards. You need to specify matte or glossy, if nothing is chosen, the order will be filled with a matte finish.

If you do not already have your front and back album covers in digital photos, you can scan them in color and email them to us. Photos taken with a camera cannot be accepted.

Please be aware that once the proofs are approved, no cancelations or refunds can be made on the cost of your USB drive 4" x 4" cover cards. NOTICE: Shipping takes longer. when you add the cover cards to your order as it takes time to get these printed, Thank you for your patience. It can take up to 14 days, unless there are unforeseen reasons concerning your delivery, such as weather delays or other problems, if this happens, the customer will be notified of an expected delivery date. The customer will not hold Company liable for any circumstances that may arise due to late deliveries.

Company warrants that material produced and delivered by Company meets Company's standard specifications for the material or such other specifications as described on this website and meets generally accepted industry standards.

All printed labels on our products are unconditionally guaranteed against defects in quality and workmanship. If any custom-manufactured product produced by Company from or through the use of materials is found to be defective in quality, or is shipped or labeled in error, Company will replace or repair defective USB drive or label product and/or correct error in shipment or labeling at its own expense or, at Company's option, refund to Customer part or all of the purchase paid to Company, on the condition that a) written notice of such defect or error is received by Company at its office within fourteen (14) days after shipment by Company to Customer, and b) the defect or error did not result from a defect or error in the materials supplied by or on behalf of the Customer. If said notice is not received by Company within the days indicated above, Company will be deemed to be released by Customer from any and all liability. Please be aware that once the proofs are approved, no cancelations or refunds can be made on the cost of your USB drive cover cards.

The Customer shall return any defective product to Company with a mail date no later than 14 days from the time customer received their order. No merchandise may be returned to Company without written return authorization by Company. Product reruns or purchase price refunds will be prorated based on the quantity of defective merchandise returned.

Prior to returning any product, you must obtain an RMA (Return Merchandise Authorization) number from Company. The RMA number must appear on your address label. Company reserves the right to refuse delivery of any item returned without an RMA number.

Company is not responsible for any loss of revenue or profit or other financial damages of any kind whatsoever, whether direct or indirect, suffered by the Customer for any reason whatsoever.

Customer must provide company with digital copies of MP3 music album(s) and if the customer is also ordering the USB drive 4" x 4" cover cards, (front and back album covers), they also must be emailed to our company at info@usb-drives-for-music-artist.com. You will receive proofs in the mail to approve. The quicker you approve the proofs the quicker you will receive your order. Once the proofs are approved, no cancelations or refunds can be made on the cost of your USB drive 4" x 4" cover cards.

Company assumes that the Customer has backups or originals of all content, as such, Company is not obligated to return such electronic content to the Customer upon completion of the order.

Company will, in good faith, exercise due diligence using generally accepted commercial business practices for IT security, to ensure that systems are operated and maintained in a secure manner, and that management, operational and technical controls are employed to ensure security of systems and data.

While Company will treat the Customer's materials with the utmost care, Company specifically denies liability for damage or loss due to fire, casualty, or negligence while the Customer's materials are in the care and possession of Company.

Customer's materials stored in Company's premises are not insured and are stored strictly at the Customer's risk.

SHIPPING INSURANCE

The Customer agrees that if they want shipping insurance coverage for its materials while in transit from Company's premises, Customer will NOTIFY the company and let them know at the time they place there order in the remarks box that the customer wants their order insured. The Company will get back with the customer for the added cost and how to pay for that added cost. If the customer does not arrange for payment of insurance prior to shipping, the order will not be insured at the time of shipping. The customer will not hold company liable for any damages or loss during shipping.

ORDER CANCELLATION

Orders for products not yet manufactured by Company may be cancelled by either party at any time within 24 hours. Once production has started, we will not accept cancellations for any reason. You must call 1-304-550-7725 to arrange for immediate cancelation, it can take several days before a refund can be returned to you.

Company reserves the right to refuse or cancel any order for any reason.

WARRANTY OF PRODUCT, LIMITATION OF LIABILITY, AND INDEMNIFICATION

Customer must inspect all products for defects in products ordered as soon as their shipment arrives. Company must be notified of defective product(s) with fourteen (14) days to request replacement or refund in part or in full. Company does not warrant and is not responsible for damages caused by misuse, abuse, accidents, viruses, unauthorized service or parts. Company shall have a reasonable time to repair or replace such products. Repaired or replaced hardware products will be warranted for an additional fourteen (14) day from Customer's receipt.

THIS EXPRESS WARRANTY SHALL EXTEND TO ONLY CUSTOMERS OF COMPANY AND IS IN LIEU OF ANY AND ALL OTHER WARRANTIES. USB Drives For Music Artist' liability under this warranty extends solely to the obligation to repair or replace a covered product(s). USB Drives For Music Artist' liability under this warranty shall not exceed the cost of the covered product(s). The foregoing warranties are exclusive and are in lieu of all other warranties whether written or implied including warranty of merchantability in other respects than expressly set forth above and warranty of fitness for a particular purpose. Further, Company shall have no liability for any consequential or punitive damages or losses to Customer or anyone else, under any theory, for defects in material or workmanship or any other reason whatsoever.

RETURN POLICY

All hardware products must be returned in the original packaging with all original accessories and documentation included. Company reserves the right to refuse delivery of any item that is not returned in the original packaging.

Returned products must be in the same condition as you received them. Customer is responsible for all shipping charges to return and replace product. Product must be returned to Company within 14 days from the date of receipt. Company will ship replacement product upon receipt of the product to be exchanged. Customer is responsible for all shipping charges to the Company for exchanged product.

Company is not responsible for any loss of revenue or profit or other financial damages of any kind whatsoever, whether direct or indirect, suffered by the Customer for any reason whatsoever.

RECORDABLE MEDIA GUARNTEE

Company guarantees that once you have received the recorded media on the USB Flash Drives, that the media will play each song as expected. Media is recorded in mp3 format and Company is not responsible if certain devices is not compatible. While most devices will play mp3 files with no problems, some devices many be defective. Please check your USB drive in another device before returning. If the returned USB drive plays on our devices, Customer will have to pay shipping charges if they want the non-defective USB Drive returned, so it's very important that you check your USB drive on another device before returning.

Company's liability under this warranty shall not exceed the cost of the covered media. This limited warranty covers normal use. Company does not warrant and is not responsible for damages caused by misuse, abuse, or accidents.
